Eugene R. Fidell and Matthew S. Freedus win Public Health Service promotion case in U.S. Court of Federal Claims
Representing a senior pharmacy officer in the U.S. Public Health Service, Gene Fidell and Matt Freedus won an 23-page decision setting aside a ruling of the Department of Health and Human Services (DHHS) in a case involving the selection and appointment of a Chief Pharmacist Officer--a flag officer position created by Congress. Judge Victor J. Wolski of the U.S. Court of Federal Claims remanded the case to DHHS for further proceedings.
The firm represents many members of the PHS Commissioned Corps in personnel and pay matters, and regularly appears in the U.S. Court of Federal Claims, U.S. District Courts, and U.S. Courts of Appeals.
