James L. Feldesman Obtains Victory in Yucca Mountain Depository Bid Challenge

On October 28, 2003, Feldesman Tucker obtained a major decision from the United States Court of Appeals for the District of Columbia Circuit, generally regarded as the second most powerful court in the country.

The case was argued by the firm's senior partner, James L. Feldesman, and involved a contract by the Department of Energy ("DOE") with respect to the much-disputed Yucca Mountain depository for high-level nuclear waste.

In 1999, DOE had sought an outside law firm to help in securing a license for DOE to operate the Yucca Mountain site. LeBoeuf, Lamb, Greene & MacRae, LLLP, had bid for that work but lost the bid. LeBoeuf Lamb, represented by Mr. Feldesman, challenged the award, contending that the firm receiving the award had a conflict of interest. Eventually, the case went to the Court of Appeals where the firm secured the victory for our client.
