Description:  Any lawyer who represents business clients will benefit from this course. As business, professional (law, medical, etc.), and real estate entities (partnerships, corporations in various forms) are formed, the desire and intent for a successful future may cause there to be, intentionally or unintentionally, a reduced focus on potential disputes and how they can affect the viability of the entity. “Commercial divorces” raise many unexpected and difficult issues that can be avoided or mitigated with planning and risk management. Our panel of faculty experts will provide you with insights on the pitfalls and best practices to help you better serve your client - from business “prenup” to “divorce” and anywhere in between. By attending this course you will:

  • Be alerted to the problem areas and gain a better understanding of what can go wrong and how to deal with such issues;

  • Learn to analyze various provisions/terms of various relevant agreements (including business formation, governance and buy/sell documents) in the context of a possible commercial divorce;   

  • Be able to better structure future agreements to avoid some of the pitfalls;

  • Be informed of the benefits and drawbacks of litigating, arbitrating and mediating commercial divorces disputes.

The course will help litigators to understand the business/transactional issues and will help the business/transactional lawyer understand the litigation perspective - so that both are better able to help clients.
