Brendan M. Tyler is an Associate in the Federal Grants and Health Care practice groups. Mr. Tyler focuses on litigation matters and assists clients on a range of transactional matters pertaining to managed care, the Medicare and Medicaid programs, the 340B program and the Public Health Service Act.
Prior to joining the firm, Mr. Tyler served as the Director of Operations for a strategy firm based in Memphis, Tennessee, where he developed field plans for state and local electoral and state lobbying campaigns, negotiated and drafted agreements, and oversaw compliance of the firm’s vendor relationships.
While pursuing his law degree at Duke University, Mr. Tyler worked as a research assistant in the Law School, and also worked for the Council of Institutional Investors where he drafted and edited comment letters and assisted in the preparation of amicus curiae briefs.
Representative Matters
- Succeeded on appeal to the Ninth Circuit in case against state Medicaid agency for violation of federally qualified health center’s (FQHCs) Medicaid payment rights.
- Obtained Federal Tort Claims Act immunity on behalf of FQHC provider in federal district court.
- Respond to and advise clients regarding subpoenas, depositions, requests for written testimony, and other third-party discovery issues.
- Counsel clients with regard to HIPAA and 42 C.F.R. Part 2 compliance.
- Coordinate with HHS and U.S. Attorney’s Offices regarding defense of administrative tort claims and lawsuits involving FQHCs.
