An Associate with the firm, David A. Bender has an active litigation practice and represents clients before federal district and appellate courts across the country in disputes relating to government investigations, the Administrative Procedure Act (“APA”), the False Claims Act (“FCA”), the Federal Tort Claims Act (“FTCA”), Medicare and Medicaid reimbursement, constitutional law, and contract law.
Leveraging his litigation background, Mr. Bender also conducts internal investigations and advises clients on the risks of litigation and strategies for ensuring compliance with myriad federal legal obligations. In addition, he counsels health care providers on their obligations under health privacy laws including the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the substance use disorder confidentiality laws at 42 C.F.R. Part 2.
Prior to joining the firm, Mr. Bender enjoyed success during law school as a member of Moot Court, Trial Team, and the Yearbook for Arbitration and Mediation. He was also selected as a National Member of The Order of Barristers for having exhibited excellence and attained high honor through the art of courtroom advocacy.
