In February, FTLF Partner Derek Adams will present at the Federal Bar Association’s Qui Tam Conference in Washington, DC, a yearly gathering of many elite False Claims Act lawyers from the defense bar, the relator’s bar, and the Department of Justice (DOJ). This year’s conference features impressive DOJ guests such as Jody Hunt, Assistant Attorney General, Civil Division and Michael Granston, Deputy Assistant Attorney General, Civil Division, and many others.
During his time at the DOJ, Mr. Adams served under Mr. Granston, then Director of the Civil Fraud Section. Mr. Granston issued a memorandum in January 2018 regarding the DOJ’s use of its affirmative dismissal authority under the False Claims Act, 31 U.S.C. § 3730(c)(2)(A). This authority allows the DOJ to dismiss a qui tam action over the objection of the relator and is an issue of great importance to all participants in qui tam litigation.
Mr. Adams will participate in a panel discussion that explores the contours of the DOJ’s dismissal authority and use of its authority in False Claims Act matters. Joined on the panel by two Assistant Directors in the Civil Fraud Section, as well as other experienced qui tam counsel, Mr. Adams will share his insight and experience as a former DOJ attorney having brought motions to dismiss under 31 U.S.C. § 3730(c)(2)(A), and from the perspective of defense counsel, now representing clients facing False Claims Act matters.
