On Monday, the Court of Appeals for the Eleventh Circuit issued its long-awaited decision in a closely watched False Claims Act case brought by the United States against AseraCare, Inc., an operator of more than 60 hospice facilities. The decision vacated a win for AseraCare, but also gave defendants a helpful standard in the Eleventh Circuit regarding medical judgment in hospice cases.
